Terms & Conditions

1. Purpose

CrystalSolutions (“the Platform”, “we”, “us”) provides a secure environment for verified employers to upload, share, and access factual employment history for lawful verification and recruitment purposes.

This service is intended to promote transparency and accountability within South Africa’s employment ecosystem, while respecting privacy, fairness, and data protection laws.

2. Acceptance of Terms

By accessing or using this Platform, you confirm that you:

  • Have read and understood these Terms;
  • Agree to comply with all applicable laws, including POPIA (Act No. 4 of 2013); and
  • Have the authority to act on behalf of your organisation (if using as an employer).

If you do not agree, you must discontinue use of the Platform immediately.

3. User Categories

  • Employers – verified business users who upload or view employment records.
  • Employees – individuals whose employment data is uploaded.
  • General Users – third-party verifiers or recruiters using the Platform lawfully.

4. User Responsibilities

Employers

  • Upload only factual and verifiable employment information.
  • Obtain written consent from the employee before submission.
  • Ensure all records are accurate, complete, and not misleading.
  • Keep documentary proof (e.g. dismissal letters, hearing records).
  • Remove or update data if found inaccurate or outdated.

Employees

  • Have the right to access, review, and dispute any data about them.
  • May request correction or deletion of personal information.
  • Must provide valid identification when submitting such requests.

General Users

  • Must use the Platform only for lawful recruitment or verification.
  • May not copy, share, or republish information for any unauthorised purpose.

5. Data Accuracy and Verification

CrystalSolutions does not guarantee the accuracy or completeness of user-submitted information.

All employers remain fully responsible for the data they upload.

The Platform may conduct verification checks but is not legally obliged to do so.

6. Subscription and Billing

Subscriptions are billed on a monthly basis unless otherwise stated. You may cancel your subscription at any time from your account dashboard. Refunds are handled on a case-by-case basis.

7. Limitation of Liability

CrystalSolutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform.

8. Prohibited Content

Users may not upload or share:

  • Personal opinions, insults, or defamatory statements.
  • Unproven allegations or ongoing disciplinary matters.
  • Health, religious, political, or union-related information.
  • Salary details without explicit employee consent.
  • Any material violating POPIA, labour law, or human rights.

Violation may result in suspension or permanent removal of the account.

9. Platform Liability

CrystalSolutions, its owners, directors, and affiliates shall not be liable for:

  • Any loss, damage, or claim arising from user-submitted information;
  • Any reputational or employment consequence caused by third-party reliance;
  • Any unauthorised access, cyber-attack, or technical fault beyond reasonable control.

Users indemnify CrystalSolutions from any claim, cost, or liability arising from their use of the Platform.

10. Data Ownership & Consent

All personal data remains the property of the data subject (employee).

CrystalSolutions acts only as a data processor, storing and managing data for lawful purposes. Employers uploading data confirm that they have obtained all necessary consents.

11. Dispute Resolution

Disputes will first be addressed through the Platform’s internal process.

Unresolved issues may be referred to arbitration or mediation under South African law.

The venue for any legal proceedings shall be the High Court of South Africa.

12. Termination of Use

CrystalSolutions reserves the right to:

  • Suspend or delete accounts that breach these Terms;
  • Remove any unlawful or inaccurate content;
  • Modify or discontinue Platform services with prior notice.

13. Governing Law

These Terms are governed by and construed in accordance with:

  • The Constitution of the Republic of South Africa (1996);
  • The Protection of Personal Information Act (POPIA);
  • The Labour Relations Act (LRA); and
  • Applicable common law principles of defamation and contract.

14. Disclaimer

CrystalSolutions functions solely as a neutral data platform. The Platform does not provide legal advice, HR consulting, or verification guarantees. All data is user-submitted and should be independently verified before use.

Use of the Platform is entirely at your own risk.
